Putting Karl Rahner and Michel Foucault in conversation shows the space of overlapping concern in their work for the relationshipbetween subjectivity and knowledge, while introducing new questions about power and history in this relationship. Both fomenta respect for mystery, through Rahnerian “transcendence” and Foucauldian “rescendence,” that while not the same, may yet beunderstood as convergent without a fully realized connection. In other words, the relation between Rahner and Foucault may beposed as “asymptotic.”.

We argue that Reasons Fundamentalism, as defended by T.M. Scanlon, faces two important difficulties—one ontological, the other epistemological—namely theontological proliferation problemand thereliability challenge.We suggest that formal constructivism can avoid these difficulties, and that Scanlon would do well to adopt it. We also show that Scanlon’s three main objections to this view depend either on a misunderstanding of what formal constructivism is or on a question-begging argument in favour of realism.

I will argue that a desert-based justification for treating a person in a certain way is a justification that holds this treatment to be justified simply by what the person is like and what he or she has done, independent of (1) the fact that treating the person in this way will have good effects (or that treating people like him or her in this way will have such effects); (2) the fact that this treatment is called for by some (...) (justified) institution or practice; or (3) the fact that the person could have avoided being subject to this treatment by choosing appropriately, and therefore cannot complain of it. I will explore the implications of this understanding of desert for the role of desert-based justifications of blame, punishment, and economic reward. (shrink)

A consideration of the full dimensions of humanism and of the humanist dimension of law invites two questions: is “humanism” compatible with theocentric religion, and therefore, is the Renaissance compatible with the “otherworldly” Middle Ages, and, has law any humanist dimension at all? The answer to the first question provides the insights that answer the second. Fully integrated humanism includes bath the Classical immanence of humanity in the world and the value accorded to the human being by the declaration in (...) Genesis that all creation is “very good”, a principle reinforced by the Incarnation of the Logos as a man. This article reports the results of a study of attitudes of future business executives towards issues of social responsibility and business ethics. The 455 respondents, who were MBA students during 1985 at one dozen schools from various regions in the United States, were asked to respond to a series of open-ended and closed-ended questions. From the responses to the questions the authors were able to conclude that future executives display considerable sensitivity, though to varying degrees, towards ethical issues in business. (...) Although previous ethical analyses of management buyouts have presented useful insights, they have been flawed in three major ways. First, they define the transaction too narrowly, emphasizing the going private aspect and ignoring the leveraged aspect. Leveraging alters the nature of the transaction substantially and warrants additional ethical analysis. Second, these previous analyses ignore the impact of buyouts on non-stockholder constituents of the firm, an omission which renders their implicit utilitarian approach incomplete. Third, these analyses do not include Rawlsian, libertarian, (...) or Kantian perspectives on ethics. This paper addresses these shortcomings and finds the ethical status of leveraged management buyouts to be highly suspect. (shrink)

Three-dimensionalists , sometimes referred to as endurantists, think that objects persist through time by being “wholly present” at every time they exist. But what is it for something to be wholly present at a time? It is surprisingly difficult to say. The threedimensionalist is free, of course, to take ‘is wholly present at’ as one of her theory’s primitives, but this is problematic for at least one reason: some philosophers claim not to understand her primitive. Clearly the three-dimensionalist would be (...) better off if she could state her theory in terms accessible to all. We think she can. What is needed is a definition of ‘is wholly present at’ that all can understand. in this paper, we offer one. (shrink)

Internalism about epistemic justification (henceforth, ‘internalism’) says that a belief B is epistemically justified for S only if S is aware of some good-making feature of B, some feature that makes for B’s having positive epistemic status: e.g., evidence for B. Externalists with respect to epistemic justification (‘externalists’) deny this awareness requirement. Michael Bergmann has recently put this dilemma against internalism: awareness admits of a strong and a weak construal; given the strong construal, internalism is subject to debilitating regress troubles; (...) given the weak construal, internalism is unmotivated; either way, internalism is in serious trouble. I argue for two claims in this article. First, Bergmann’s dilemma argument is unmotivated: he’s given no good reason for accepting one of its crucial premises. And second, Bergmann’s dilemma argument is unsound: the crucial premise in question is false. (shrink)

The typical Cartesian collection contains papers which treat the problems arising out of Descartes's philosophy as though they and it appeared for the first time in a recent journal. The approach of this collection is quite different. The eight contributors concentrate on problems faced by Cartesianism which are of historical significance. Without denigrating the importance of the technique of exploiting the texts in a manner that appeals to contemporary philosophical interests, the contributors show how Cartesianism was shaped over time by (...) the criticism it received. This criticism took place in many areas - politics, theology, natural science, and metaphysics - and its scope is reflected in this collection of papers. The efforts of advocates of Cartesianism to produce a biography of Descartes, and the political difficulties they faced, are no less a part of the problems of Cartesianism than are the difficulties alleged against the Cartesian ontology of thought and extension in accounting for transubstatiation. Seventeenth- and eighteenth-century theories of the formation of the earth, for example, were historically part of the same set of problems as the difficulties in Bible criticism. ABSTRACT:Employing utilitarian criteria, Jones and Felps, in “Shareholder Wealth Maximization and Social Welfare: A Utilitarian Critique” (Business Ethics Quarterly23[2]: 207–38), examined the sequential logic leading from shareholder wealth maximization to maximal social welfare and uncovered several serious empirical and conceptual shortcomings. After rendering shareholder wealth maximization seriously compromised as an objective for corporate operations, they provided a set of criteria regarding what a replacement corporate objective would look like, but do not offer a specific alternative. In this article, we draw (...) on neo-utilitarian thought to advance a refined version of normative stakeholder theory that we believe addresses a major remaining criticism of extant versions, their lack of specificity. More particularly, we provide a single-valued objective function for the corporation—stakeholder happiness enhancement—that would allow managers to make principled choices between/among policy options when stakeholder interests conflict. Mais le problème est de distinguer entre Gassendi et ses disciples contemporains de Locke comme source immédiate d'inspiration pour celui-ci. Ses Commonplace Books attestent que Locke avait lu Gassendi avec attention, et son Journal indique que pendant ses séjours à Paris, il fut en contact avec des gassendistes tels Bernier et Launay, dont il acheta les oeuvres pour les emporter (...) en Angleterre. L'analyse que Locke fournit de l'espace est d'un intérêt particulier, car tout en témoignant de l'orientation que Leibniz attribuait à Locke, elle s'écarte nettement des vues de Gassendi sur la question. Many analyses of notion of _metainferences_ in the non-transitive logic ST have tackled the question of whether ST can be identified with classical logic. In this paper, we argue that the primary analyses are overly restrictive of the notion of metainference. We offer a more elegant and tractable semantics for the strict-tolerant hierarchy based on the three-valued function for the LP material conditional. This semantics can be shown to easily handle the introduction of _mixed_ inferences, _i.e._, inferences involving objects belonging (...) to more than one (meta)inferential level and solves several other limitations of the ST hierarchies introduced by Barrio, Pailos, and Szmuc. The moral worth of attorneys has traditionally been judged in terms of compIiance with legal codes of ethics. These codes, ostensibly designed to promote smooth and equitable functioning of an adversary system, are manifestations of a rule utiIitarian moral system. This paper argues that ethical attorneys have a higher calling than rule compIiance and that "moral commitment," which combines commitment to "right" solutions and moral courage, is a superior yardstick for measuring their moral worth.
